Personal Achievement : 2015

Is it too late to write about the new year? How about resolutions?

Resolutions do not always have to be planned to commence in the very early of each year. Bila bila pun boleh pasang niat dan azam. I use to jot down my resolutions and then I memorized them and right now I am at a point where I can't be bothered about resolutions. 

Year 2014 was pretty a smooth year for me dari segi kerjaya mahupun personal life dan kewangan. Alhamdullillah. 

Two most important things that happened in 2014 was:-

1) I got engaged; and

2) I stayed with this firm for a year.

You have read the story about my engagement in previous posts. And i never really openly discussed about my worklife.

This firm, I learned about this firm a year after I graduated law school doing Bachelor in Legal Studies. While some have dreams about joining huge firms like Skrine or Lee Hishamudin, I told myself, one day I want my name to appear on this firm's letter head. Sebenarnya itu angan-angan yang tak serious pun. That was when I was 23 24 years old. Fast forward 4 years later, I joined a firm. Lasted for only 2 months, it was a hell for me. Tak ngam dengan cara kerja, environment, benefits ntah hapa-hapa. Even masa tu tak kerja, I left the firm. I could not tahan with the ridiculous office politics. I was jobless for nearly 3 months in 2013. 

Enter November 2013, a friend recommended me the firm. This firm. Terkejut yang tak terhingga that she was in this firm. I went for the interview and I got a post in this firm. This firm!!! Macam-macam jugak jadi selama 13 bulan kat sini. Ada yang membawa kepada tangisan. Friends joined and left the firm. Some sooner than I thought they would. Ketika time time cilaka, contoh kena marah dengan boss stok kau kau punya sebab screw up file, I made a promise to myself. One year! I need only one year. To let this firm's name mewangikan diri and I would sell myself out. Today, di kala dah selesa kat sini, I decided it is time.

This time, I am leaving because I was headhunted. My promise paid off. That promise untuk mewangikan diri tu. 

Sedih because this was my dream. To have my name on this firm's letter head. But I think the best time to move on is when you are at your peak. Sedih jugak sebab dah ada kenalan rapat, ada staff yang faham cara kerja kita, senang... Now, dah tak challenging. 

I read in few career websites - reasons to leave your current job. I dont fit all the reasons. I dont hate my boss, I dont hate my job, I definitely dont hate the environment here. Progression, ada sedikit tak puas hati tapi masih tolerable. Tempat ni, office politics? None! Although some do play the race card. But masih tolerable. So, yea I am sad to be leaving this firm. 

The new firm, been getting good reviews from previous employees (which are the people in my circle of practice). So I hope I am making the right move. Mom said I "risk too much - baru nak selesa dah pegi quit job". Tapi, kerja makan gaji ni, takkan nak tunggu 3 4 5 tahun baru nak nampak hasil yang secoet tet kan?

I remember seeing a poster stating something like this - "Love your job, never your company. Because you never know when your company will stop loving you"... Love my job... InsyaAllah boleh survive biarpun di firm lain.

So, come February, I hope to see my name kat letter head firm lain pulak. Cross my fingers.

Lawyers

I like some really old senior lawyers. Sometimes when I met them in Court, knowing that I am very junior, they tend to give me nasihat-nasihat berguna and always menegakkan that a senior lawyer is a mentor to junior lawyer and in this fraternity, we are family. Since we are family, it is the duty of senior lawyers to always guide the juniors.

Tapi ada sesetengah masanya, dalam transition from a young senior lawyer untuk ke arah very old senior lawyer, keangguhan muncul. And this is what happened to me just now.

It was my mistake. I overlooked a file and did not attend the Court which was fixed for Hearing. We, however have instruction to concede liability at 50/50 from our client. Konsep ni mungkin readers tak faham. Since, I did not attend the hearing date fixed, Plaintiff lawyer gunakan peluang ni untuk kenakan Defendant (which I represent). He conceded liability without our consent.

I am young and still learning the ropes of this path, really. This is the same opponent which made me wait for him for four hours (on other case) di mana I tak habis-habis call dia tanya if he is coming. I made it an effort to contact him, kot mana tahu dia lupa dia ada kes. Orang kata bila kita buat baik, di balas dengan kebaikkan jugak kan.

For my matter, he said he waited like fool until 12pm and nobody showed up. If he had some courtesy to call the office, someone could have gone to the Court. But when I humbly and politely put it to him like that, he screamed and said "do you think I am your office boy ke? I have to chase you to do this and that?". So I apologized and admitted it was my mistake, I overlooked the file but I wish to know what happened on the hearing date that I did not attend. He yelled again. This time saying "you expect me to tell you about your file is it? Is this how you conduct yourself as a counsel? Asking the opponent lawyer to tell you about your file?". Isu nya mudah, I was not there when you conceded the liability. My mistake I admit but assist la on what happened on that day. I did not know what happened on that. How much liability you conceded and all. Soalan mudah je. Tapi he tortured me with words sampaikan I literally cried while I was on the phone with him.

Dalam masa yang sama, my heart was breaking when I learned he conceded liability without our consent. What if dia concede liability 100% against the Defendant? Client will go crazy and when client jadi gila, bos takkan gembira dan here in this office, we are not family. We are literally employers and employees so when you screw up, just be ready to pack up your stuff and leave. Boss takkan backing kau atau offer solutions. Nope. Boss will scold you bloody murder and sack you. The damage control will be done after you left. Yeah, real world of "makan gaji". Happened to a colleague. So yeah, I am dead scared of losing this job.

So, berbalik kepada isu my opponent tadi. Suara dah makin putus sebab tahan air mata, I asked again how much liability he conceded. And his voice turned slow. 50/50 he said. Hati lega sangat sebab sememangnya kami ada arahan dari anak guam untuk concede liability at 50/50.

I thanked him and hung up the phone and menangis sepuas-puasnya sebab pertama : takut dengan office; sebab kedua : buat baik kepada orang tidak sama sekali di balas baik. Or may be, di balas baik tapi bukan dari orang yg sama.

I dont know if every lawyer pernah kena sembur macam ni during thier early years as a lawyer because some of them could be really arrogant. Some very senior lawyers are very humble and polite. However it is, this is a lesson for me and I am writing this so I remember how I feel today and I dont ever want to feel like ever, again.

Keep a proper attention to Court's diary and your opponents and colleagues are not your friends, let alone your brothers and sisters in the fraternity. Those are just craps, really.

Advocacy Training Course

"Advocacy is an art, acquired by practice"

I dont know who said that.. I can't remember... It  came up while I started writing.

One must know being a good lawyer, you have to possess two main characterictics i.e. wide knowledge on laws & advocacy skills.

Anyone can read books, get some research done to possess a wide varient knowledge on laws..but to put that into practice requires some other skills, altogether. As such, my boss registered me to attend this "i thought i would hate it" training course for two days held at Kuala Lumpur Regional Center of Arbitration.

Fun Fact #1: That building used by KLRCA is formely Tun Sri Abbas' residency before he was removed.

Expect the great "homey" enviroment upon arrival. KLRCA is a great place for arbitration. Soothing and calming with birds chirrping and all of this in the heart of KL. Unbelieveable.

Now, back on track.

The fees my firm paid for was RM500.00 for 2 and a half day (workshop) course.

We were given our materials before hand for us to prepare and honestly, I didnt know what to expect. Yet i had known that those materials were going to be used extensively during the course, I would have made a better preparation to equip myself of such information.

Day 1 : Friday (evening) : Briefing @ Bar Council

We were given a brief introduction of what to expect during the course. We did a little mini case analysis during the briefing to give ideas on what we have to go thru the next two days. There was Q&A Sessions on dress code and such. They allocated us in 5 groups of 6 participants of various years of experience and practice.

Day 2 : Saturday (9.00 - 5.30) @ KLRCA

Participants are required to adhere to the dress code of in chambers; Full Court Attire with blazer and black shoes. First task is to Exam-in-Chief the witness. We were given a schedule of our roles and we took our roles in rotation. It was furthered with Cross-Exam and later Submission for application for Injunction and oppossing. The Submission was recorded on video for reference and comments.

These tasks are done and evaluated individually. What's about it that the comments were given on the spot. You can be in the business for 20 years and yet never realized that you have not acquire the proper skills of advocacy. This is the trainers job; to correct and delevelop an effective advocacy skills among the participants.

Day 3 : Sunday (10.00 - 4.30) @ KLRCA

Again, Exam in Chief and Cross Exam tasks are put as starters on this last day, but, with video recording this time. On this day, we were able to grapsed few points taken on the first day and put it to use to strengthen our skills and boy, it is effective. We recieved good feed back about our performance and it has enhanced our self-esteem and confidence to present our case. And then it was  for Submission after lunch time as "desserts".

Over all, I must say this is a great effort of the team and Mr Brennan as the organizer to hold such training course for fellows legal practitioners. It is beneficial to every level of lawyers and it had certainly benefited me, the new lawyer in so many ways I cant tell.

The food was super great.. I swear I love the lunch meal. The trainers (who are all successful seniors lawyers) are super friendly and attentive and helpful throughout the entire course. We would sit while having lunch and discussed about the profession. There was no gap between us. There, we were colleagues.

For young lawyers, i urge to join the course when it comes to your town. I had the chance to join as very senior lawyer with the title "dato" as participants. Even him made mistakes while submitting in the court. You wouldnt want to miss the chance to better yourselves. So, register. Seats are limited.. Cewahh.... iklan pulak..

Long Call Ceremony/ Sample Deraf Perintah Long Call

Pada tanggal 30.05.2012 ianya secara rasmimya I am installed (ditabalkan, cewahh.. mcm anak raja ni) sebagai Peguambela & Peguamcara di Mahkamah Tinggi Malaya.... (sah??? sah??? sahhhhhhh sume tadah tangan baca doa selamat, lekas)

It was hectic sebab the day before the Long Call ceremony, Ipoh Court dan Perak Bar dok call sebab my papers were not in order (atau bahasa orang biasa [lay-man]) surat-surat tatacara tidak lengkap gitu.. Iols dah berpatah arang dah on the 29.05.2012.. Redha je la kalau Long Call kena tangguh ke tarikh yang lain sebab system e-filing ni, biarpun "kemudahan di hujung jari" je, dia punya lagging, kalah orang jet-lag.

Supposedly, on the  29th tu, I dah gerak balik Ipoh untuk buat preparation, tapi I woke up at 10.00 am and terpaksa rushed ke office untuk sediakan semua semua document yang tak lengkap tu. Sudahnya pukul 9.00 malam baru gerak balik Ipoh. Sampai Ipoh kol 12 mlm, dah lunyai dah... T___T 

Reminder :
Before your Long Call tu, call semua pihak (yang merangkap):
AG Chambers, Bar Council dan setiap State's Bar to make sure that your papers are in order. Perak Bar's Ms Karen sangat baik.. She had been very very helpful and supportive & patience mengendalikan my papers. Thank U, Miss Karen from Perak Bar.

The Next day, woke up @ 6.30am. My mom was a nervous wreck, dia ingat tak cukup masa nak buat sume benda. Dia dok mencicit la mcm burung gerak anak2 dia bangun... I mean, driving from my house to Ipoh Court cuma dalam  20 mins. Ceremony started at 9.00 am... bangun kol 6.30am.. Iols ni, kalau ada kes kat KL Court tu, naik turun LRT Komuter sume tu pun, I akan bangun kol 7am.. Rileks la Omma... Anyway, pagi tu mak buat my fave kuew teow goreng dengan sotong dan udang berketul2.. Treat ke ni? Ahaks.. Enjoyed my breakfast~~ Thank u, Omma..

Kol 8 pagi sume gerak ke Ipoh High Court yang tersergam indah itew.. Tak de gmbr sebab malas nak bawak kuar "pinky" (nama my camera) :P

My robe was with Ekin (sebab pinjam Ekin punya) dan she was nowhere to be found. Aduh, bulu ketiak sudah gatal2. Mana Ekin ni? Calling2 tak dapat.. Dok drive kot.. Never mind. Its still early..

8.30 am.. Ekin punya bayang2 langsung tak nampak lagi ni.. Oh no!!!!

Tak pe.. I took the time to check with the Court's Interpreters nak tgk sama ada all suratcara in order ke tidak.. They gave my my file and ada nota di atas "All Papers are in order"... Wahh kenyamanan hati yang tak terbendung.. Tak de masalah lah...


8.50 am, Ekin sampe.. iols merampus mcm Joyah kat perkarangan Court tu sambil Ekin terkocoh2 datang bawak robe ahaks.. Ilebiut, Ekin..

So, I am the first up...

Buzzer dibunyikan tanda Hakim sudah naik on bench. Sume tunduk hormat. Haaaa kau nak tahu Mahkamah Ipoh ada Bendahara berdiri sebelah Hakim siap dengan selempang merah kat dada... Iols rasa dia mcm hulubalang istana gitewww..... 

Oh yea.. sebelum uols menghadirkan diri ke Mahkamah Yang Mulia itu, sila la bawak Deraf Perintah seperti yang di atas ini oke?? Terima kaseh :))

Yea..... no Petisyen 18-835-2011 di panggil, iols dengan gemuruh jiwaaaaaaa!!! semangat membaraaa!! dari puncak (ok tak ingat lirik dah).... berjalan ke depan.. tunduk tanda hormat.. Court de Corum kena jaga ya rakan2 taulan.... Tak pasal2 kang Tuan Hakim murka... Nanti kena lembing dengan Bendahara...

My mover (nama dirahsiakan; rahsia ke tu kat Deraf Perintah ada nama beliau) pun berdiri memberi ucapan... 3 mukasurat speech dia.. Basically this speech adalah ucapan tentang latar belakang Pempetisyen (yakni iols).. Dia cite la anak sape, lahir kat mana, hobi ape, kejayaan terbesar dan semuanya dihubungkaitkan dengan pengajian undang2. Habis sume Legal Practitioners punya quotations dia quoted... Iols tahu my sista kat galeria tu tergelak2 dengar Encik Mover tu meng-hyperbola kan my biodata.. Chiettt...

Setelah dekat 10mins berdiri mendengar cerita tentang diri sendiri (i admit ada sedikit rasa sayu sayu salju kat situ - sebab suddenly ada flash back of ur life through law schools kat dalam minda, kepayahan kau panjat bukit tonggek kat uitm tu, naik bus turun bas, redah ujan. bersengkang mata study cases, fail paper sebab putus chinta sume ada la... and at the end, kau berdiri di sini, one moment away to be admitted as a Peguam). Pung pung pung.. terus Hakim kata... "Perintah Seperti Dipohon" Wehewwwwwwwwwwwwww~~~~~~ I am  a fricking lawyer... Kau main main la.. aku shaman kang.. kekekeke... 

akhirnya!!!! kini pasti (gaya anita sarawak) Sarawak?? eh.. terkenang le pulok.. T__T

Encik mover memohon dari Mahkamah supaya my Omma yang sarungkan Robe (Jubah).. so my mom yang sememangnye nervous itewww... bertatih ke hadapan, tunduk hormat pada Hakim dan menjengket2 sarungkan Jubah kat anak dia yang tinggi lampai ini.. kekek

Ok... pada orang yang tak tahu apa significant Jubah ni.. dan yang dok kata "alaaaa sarung jubah je ke??"

Jubah Peguam ni, bukan sembarangan orang blh pakai. Kalau uols nak tahu, ianya telah termaktub di dalam Akta Profession yang orang yang tidak berkelayakan TIDAK BOLEH pakai jubah ni dan sekiranya didapati pakai, derang akan dikenakan tindakan for Contempt of Court (menghina Mahkamah). Chambering students jugak tiada hak untuk pakai Jubah ni sebab Chambering student tiada Locus [hak] dalam Mahkamah Tinggi Terbuka [Open Court].. So, after ditabalkan menjadi Peguam Mahkamah Tinggi, baru lah iols ada hak untuk pakai Jubah tu. 

Setelah disarungkan Jubah, maka iols pun berjalan2 kembali ke tempat duduk sebelah kandang saksi.. :))

After the ceremony, ada upacara mendapatkan tandatangan dari Peguam AGC, Peguam State Bar atas Deraf Perintah. Korang jangan main cabut je. Lepas tu, baru la ada sessi bergambar.. kelik!! kelik!!

Ooo panas.. tak byk gmbr blh di amik...sekian..

terima kaseh Ekin kerana pinjamkan jubah dan hadir kat ceremony ni.. tak de la aku rasa cem lone ranjer gila tak rakan taulan hadir.. Ilebiu.. Nanti aku belanje setabak, wokeyy?

Ok!! Time yang ditunggu-tunggu telah tiba.. 

I am so sorry for not spending time to update this blog in relation to Chambering dan perkara2 seangkatan dengannya. Thank you for the e-mails sent. I think I have replied to all the emails. Tak menyempat2 ya uolls nak tahu pasal Filing Borang 6 7 8.

Have you met the pre-requisite requirements?

IF sudah, then, marilah kita proceed to the process of filing the Long Call Forms.

Isilah borang-borang yang berkenaan seperti dibawah:-

List of Enclosures for Borang 6 are as follow (mengikut ekshibits): 

(you can refer to the Borang itself, but to avoid any confusion, please refer to the list below)

(a) Salinan Sijil Kelahiran;

(b) Salinan IC;

(c) Salinan Degree;

(d) Borang 7 (2 salinan);

(e) Borang 8 & Salinan Sijil Pengecualian BM;

(f) Salinan Sijil Ethics;

(g) Salinan Sijil Penampalan yang telah dimeterai.

**You must also bring your INSTRUMENT & RECEIPTS OF PAYMENT paid to the   DICIPLINARY BOARD & BAR COUNCIL

[YOU NEED TWO OF THIS FORM (Dua keping) - ISI DENGAN DUA NAMA YANG BERBEZA]

The names do not necessarily ikut nama yang uols dah include dalam referee forms u isi when u first started off ur chambering tu. Anyone's name will do.

This is "Sijil Pengesahan Dokumen"


Dokumen inilah yang akan dikeluarkan after the Court had checked yang semua salinan yang uols enclosed dengan Borang 6 tadi sama ke tak dengan documents asal.

This is "Notis Perbicaraan"
Your Long Call date will be on this document upon extraction from the e-fling system.

As for my case, I want to be called in Ipoh, so they handed me forms, looking like this.. 

I am sure, there is another copy.. will update of the second form.. Hilang ntah ke mana dah..

Uols akan mendapat arahan untuk serahkan surat2 di atas bersama-sama dengan Instrument kepada court di mana u want to be called. Serve that items ASAP sebab selagi uols tak serahkan Instrument kepada Court berkenaan, u wont get ur Long Call date.

Wait for a few days, u can extract the "Sijil Pengesahan Document" and akan ada arahan atas sijil tu untuk uols filekan Afidavit Penyampaian 14 hari sebelum tarikh bicara. I was like blur blur rabbit jap, nak serahkan ape?? Rupanya Borang 6 tu, kena serahkan ke respective bodies [mcm Borang 1 2 & 3 4 5 dulu tu]... Bar Council, State Bar & AGC & pastu filekanlah Affidavit Penyampaian DAN State Bar (uols kena serve the whole documents from Borang 1 -> Notis Perbicaraan)

and then, after serving all the documents, sila la filekan Afidavit Penyampaian dan serahkan satu salinan kepada State bar.. 

Filing Fees : RM128.00 not inclusive bayaran affirm affidavit Borang 6 dan Sijil Perakuan Exhibit.

If you need to amend anything, uols blh la pegi kat Bar Room, Tingkat 5, Sayap Kiri. I am so surprised that ada few of my friends tak tahu wujudnya Bar Room ni.

Tentang selok belok dalam Court tu, i think i dont have to explain more lah.. By now, I think u should have known keadaan di kaunter bayaran KL Court tu kan??

Pre-requisite Requirements [Borang 6, 7, 8]

To speed up process of filing your Long Call Papers, you need to do the followings:-

File the "Sijil Penampalan" ASAP


Sijil Penampalan is a required document as you have to exhibit the sealed copy with your Borang 6.


What you need to do is to go to the Court, ask the staff that you want to file the Sijil Penampalan. She/He will give you a form and a stack of Affidavits from 'penampal notis Mahkamah' from all over Malaysia saying that they have tampal your Borang 2 di Papan Notis Mahkamah-Mahkamah Tinggi seluruh Malaysia. You have to fill in the dates of penampalan according to states in the form the give you.


Dah habis isi, file it.. Seperti biasa di KL, its filing.. Have waiting for ur number to be called. Payment for the said "Sijil Penampalan" is RM20 + Scanning Fee " RM10. So, total: RM30.00.


I got my sealed copy on the next day.. cepat kan? so, no fret tentang tempoh masa extraction of the said document. Seperti biasa, extraction adalah di website kehakiman e-filing. U should know the drill lah by now kan?

Obtain & Submit the Confidentiality Reports ASAP

Upon compeletion of your 14 days Legal Aid Service, get the Confidentiality Report from the State Committee and YOU MUST, WITHIN THE SAME DAY, pass the Confidentiality Report to the Bar Council.

They are going to need it so they can prepare another Confidentiality Report and pass it to the KL High Court.

(Approx time of extraction of the report from the State Committee (as in my case that would be the Selangor Bar : 7 days) - keep calling them to find out if its ready)

I dont have the sample of the Reports because its confidential.. I didnt even lay my eyes on the report :))

Make the necessary payments

Make payment of RM200.00 at the Diciplinary Board @ Wisma Maran, KL

I am so sorry, I dont know about states outside Selangor whether u have to come over to KL to make the payments or you can just settle it at the state Diciplinary Board. Kindly, call your State Committee for futher clarification.

(retain the receipt of payment - u are going to need it when filing your Long Call Papers)

Also, make payments of RM30.00 @ Bar Council.

This payment is for your Instrument (ur sijil saying ur now an Advocate & Solicitor) which will be given to you on ur Long Call day. The Bar Council will hand the Instrument to you so you can pass it to the Court.

(again, please retain the receipt because you are going to need it when filing your Long Call Papers.)

Exempt BM / Ethics short tips

Baiklah murid-murid. Kali ni cikgu nak ajar cara gi mana nak apply untuk dapatkan pengecualian Ujian Bahasa Melayu untuk kemasukan sebagai Peguamcara & Peguambela.

This will be a short entry sebab its easy.

Sebelum tu kot kot ada returning readers yang datang jenguk2 cari entry pasal Exam Ethics.. mintak maaf.. tak de entry tentang Ethics although, I can give u some tips.. Flip through the huge, thick manual yang Bar Council kasi tu k.. U can tiru bulat2 from the manual buat U need to know which page to look the answers for sebab time tok jawab is very limited.. Mana nak nyelak page.. Mana nak nyalin.. so just go thru the pages before going into the exam hall k.. And try to go to the briefing Bar Council buat a day before the exam. Memang bosan tahap dewa tapi it helps a lot (for those yg malas nak baca manual tu mcm i ni kan).. Short note : Exam Ethics is something u should not be afraid of. I know the pressure is so high sebab satu soalan uols tak jawab, confirm2 fail.. just jawab.. ekau goreng la ape pun jadi jawapan tu logik. Hokey???

Lain lain tips tu adalah be punctual.. Punctuality is something they take very seriously.. seminit lewat pon tak bley.. Eleh kunun lawyers sume kena punctual.. ahaks.. Berapa antara korang yang pegi Case Management kat Court start kol 9.00 pagi, tapi pukul 9.00 pagi baru turun dari kereta dari parking lot?? (saya!! saya~~ sambil angkat tangan).. Chill la, bro.. lewat sminit je pon.. Ok.. point is.. Jangan lewat.. Cemana korang pegi exam masa belajar dulu tu.. cem tu lah.. Ahaks..

Ok.. pasal Exemption BM ni.. uols kena buat before korang filekan borang Long Call. Time estimated for the to extract the Sijil is 3 minggu but I have received a lot of complaints that they took more than 3 weeks to extract the Sijil.. so u migt wanna do it ASAP before u file ur Borang 6, 7. 8.

I tried googling for information of the Lembaga Kelayakan Profession Undang-Undang Malaysia, it was hard to find.. So I called them and asked sendiri..

Ok.. what u need :-

(a) Salinan Sijil SPM yang diakui sah  oleh Pegawai Kerajaan Gred A; dan

(b) Cek bernilai RM100.00 as the fee atas nama "LEMBAGA KELAYANKAN PROFESION UNDANG-UNDANG MALAYSIA". ~ (Profesion tu satu 'S' sahaja tau)

Collection method ada dua. Its either u can collect it by urselves atau mintak diorang kurier kan.. of which u must add another RM10 for courier service charge. (documents hilang tanggung sendiri tawwww)

Short Call - Preparation & What To Expect

Kali cem agak lewat nak post pasal Short Call sebab aku tgh "in love".. Ape kejadahnye, being in love dengan short call entry? Tak de kaitan langsung...tapi ianya membuatkan aku malas nak update blog biarpun aku online sekarang, luar biasa lebih lama dari kebiasaan.. chatting kat FB dan the Sims kottt... kome ni... suke pikior hok buke buke.. (gabungan dialek beberapa negeri - baru la 1Malaysia).

Tarikh short call aku adalah 21.09.2011 aritu. OK... Preparation before short call:-

• Make sure korang obtain "Letter of No Objection" from the Bar Council and State Committee 7 working days. 
• Sekarang KL Court telah menggunakan sistem e-filing so, get the letter to the court and get them scanned.

Cara-caranya (ctm style):-

Gunakan despatch untuk hantar both letters from the Bar Council and State Committee to RKKK and get acknowledgement for both letters. These letter will be scanned into the system, free-of-charge.

• Two days after that, confirm dengan RKKK yang those documents telah pun di scan ke dalam system.

I was told a thousand times to "ensure your documents are in order" and I didnt even know what that means. Rupanya "getting your documents in order" tu bermakna, call court tanya if there is any problem with your documents, syncronized kan documents korang dalam file korang and make sure, korang susun documents korang tu baik2 supaya mudah nak dicari dan mudah dicapai. Be sure to have copies of all the documents.

Unfortunately, aku tak tau pasal benda ni.. Ingatkan cukup setakat semua benda ada, salinan lengkap bla bla bla.. dah setel..

Nehi!! nehi!!

I didnt call the court to confirm that my letters ob no objection dah discanned and i didnt call the court to confirm that my papers were in order.

So, when I arrived at the court on my short call day...ada sedikit kecelaruan. Mujur la sampai awal sebab before short call start, the Juru Bahasa will check in their list if your documents are in order. My document - affidavit penyampai borang 3, 4, 5 tak de katanya -. Runtun hatiku, apekah aku akan dapat short call date yg lain?? Di sini pentingnya to have all the documents at the tips of ur finger. I brought along segala resit pemfailan, payment invoice dari court, segalanya i bawak dalam satu file, because u never know what you're going to need.

Since i had everything in my file, i pon kuarkan la evidence segala bagai yang i had filed the affidavit earlier.. Check punya check, rupa nya ada kesalahan di "title" affidavit. I quoted the wrong section. (For more information  - please contact me - sangat tak rajin nak edit gmbr and upload [sebab tgh in love]). Mujurlah blh amend dengan pen je... Kalau tak, naye je kena delay short call..

So, when amendments is made, the JB will ask u to check dengan RKKK if ur letters of no objection dah ada system.. Terkatek-katek la ai pi turun ke RKKK untuk check. So, that is why i would suggest you call before hand to ensure that your documents are in order.

I was moved my Mr. Marcus Low, a friend of my Senior Partner. I have been getting and reading a lot, where pupil say that it is best to bring a move from another firm (not the from the firm your doing ur chambering). Now, ini satu perkara yang aku sangat tak faham, sebab bila aku tny Miss Lillian (Bar Council [Admission]), dia kata seelok2nya Master yang pergi sebab atas Saman Dalam Kamar (Borang 3), Master yang memohon. Aku pon tak berapa nak faham. Dan Mr. Marcus moved me sebab one of the LA dalam my firm taknak move me (sebab she is serving her 7th year - so dia takut ianya melanggar etika)... Itu adalah BS sebab kawan aku Noorashikin Sharifuddin (3 years practice) dah move beberapa chambies untuk short call.. Saje bikin gempak LA ni.. gerem aku..

So, what happens during short call?

I was so amazed that short call depan Hakim (dalam kamar)  tu took only less then 2 minutes.. What I heard Mr. Marcus said was "Dengan izin YA.. saya bla bla bla mewakili Pn Mazlina bagi satu permohonan di bawah bla bla bla... Saya juga percaya bahawa terdapat sedikit pembetulan di afidavit penyampai borang 3, 4, 5 bagi kandungan 4 (SDK) dan ianya telah dibetulkan" And then, the Judge confirmed the pembetulan.. Mr Marcus continued "Lain lain dari itu, saya percaya bahasa kertas kertas kausa berada dalam keadaan teratur. Maka, saya ingin pohon satu perintah seperti yang di pohon."

The Judge tulis2 sikit.. terus "baiklah.. perintah seperti yang dipohon"

Dah.. Setel... Keje korang, dok dendiam je sebelah mover tu.. And then, when you got up from ur seat, have some courtesy to say "thank you" to the Judge, even dia tak pandang pun muka korang.

Also, to save time, please prepare Draft Judgment untuk disubmit dan dan tu jugak bagi memudahkan proses korang mendapatkan Fair Judgment dalam masa yang dekat. Ingat Draft Judgment tak kena byr. Masa nak filekan Fair Judgment baru kena byr - RM40.00

So, itulah dia citenya.. Senang je kan?
