Pemfailan Borang 3, 4 & 5 (Chambering) - My Experience


Hi there!!
This is a continuance of my experience of filing my Borang 1 & 2 untuk kemasukan sebagai Peguamcara.


You see, Borang 3, 4 & 5 adalah sangat senang di isi sebenarnya sebab, when you read the Forms, you know what to fill in the blanks.

I shall assist you cara2 nak isi Borang tu somehow. Please refer kat photos di bawah hokey?? [sila klik kat gmbr for larger view].. BTW, Borang 3 di bawah adalah rupa Borang yang telah diektrak dari sistem online e-filing...  Pas ni tak de sape dah blg tiru cop Mahkamah... hik hik hik...

BORANG 4 - AFFIDAVIT MASTER

BORANG 5 - AFIDAVIT PELATIH DALAM KAMAR


At this stage, you must file together Affidavit Penyampaian yang membuktikan uols dah serahkan salinan Borang 1 & 2 kepada pihak2 yang berkenaan.

Apa yang perlu dikepilkan dengan Affidavit Penyampaian tu, (mengikut aturan untuk Ekshibit):-
a) salinan acknowledgement respective bodies yang menerima Borang 1 & 2
b) Salinan Borang 1 yang termeterai
c) Salinan Borang 2 yang termeterai

Affidavit ni, TAK PERLU di kepilkan dengan Borang 3, 4 & 5. It stands on its own.
So, when you go to the Court for the 2nd time to file ur borang berkaitan Chambering, u must have 4 documents:-
a) Borang 3 (Saman Dalam Kamar)
b) Affidavit Penyampaian
c) Borang 4 (Affidavit Master) - nama pemohon adalah nama MASTER, oke..bukan nama pupil
d) Borang 5 (Affidavit pupil) - refer above

I have rambled on tentang system pemfailan electronik di KL court.. Not cool, eh.. So, berbekalkan pelajaran masa filing Borang 1 & 2, I started my journey early.. This time, I went straight to Bar Counsil (Masjid Jamek LRT Station) to catch 'the white van'. I arrived there around 8.45 am and there are still few vans waiting for passengers... Phewww.. The journey to the KL High Court took around 20mins. So I arrived at the Court early.. Yiipi yeay!!!

I went straight to Bahagian Rayuan & Kuasa Kuasa Khas (RKKK) and let them check my Forms.. Lucky me, tak de masalah, so I was all set untuk filing.. This time, my encounter dengan kakak2 belakang kaunter RKKK tu phailed!! big time!! They are rude and sangat sangat tak helpful. It is as if they are trained to be rude dengan kita.. Hmmm I dont remember tunjuk act ngan derang pon tapi ntah la.. My 2nd visit to RKKK left me feeling sangat marah dengan kakak2 belakang kaunter simply because they are rude.. so minus point kat situ..

So after approval, I rushed to the scanning counter to get my number.. Orang tak ramai, so I made muka bahagia la bila tgk kat tiket only 10 more numbers before my number (unlike last time - 150 orang menunggu before me)... But, na aa aa jgn tertipu... That 10 numbers before me took one and a half hours to settled before my number was called... So, my nasihat... Be there as early as possible..

When my number was called, the guy couldnt process my documents.. Katanya sebab Borang 1 dan Borang 2 tak approved lagi.. Haaaa??? but I have made my payments and all.. Agak amik masa jugak la kat situ..  Kekeliruan tu berlaku kerana masa I file borang 1 & 2, I didnt return to the "kaunter invoice" to confirm my payment. So, the system showed that I havent paid my filing fees for Borang 1 & 2. Moral of the story : Lepas bayar untuk Filing Borang 1 & 2 - sila la pegi balik ke kaunter where you got ur invoice and comfirm kan la that u have made ur payment of the filing fees..

So, when semuanya dah setel, abg kaunter 15 tu pon scan lah my document.. Then he will return the documents to you and then you have to wait for your number to be called again for u to get ur invoice so u can make ur payment.. tunggu la kejap, dalam 10 - 15 minit...
Upon getting ur invoice, pegi la kaunter seberang (kaunter pembayaran) and make ur payment - RM44.00 semuanya. Process pembayaran ni sekejap je.. Tak de hal..
Dah setel dengan payment... tanya la dulu akak kaunter pembayaran tu, nak kena pegi kaunter invoice balik ke tak.. Kang tak pegi kaunter invoice, tak dapat date short call pulak..
Lepas byr, maka setel lah sudah process pemfailan Borang 3, 4 & 5 korang...
That copy of the invoice, SIMPAN sebab kat situ ada EXTRACTION CODE which korang perlu extract Borang 3 online thru website e-filing. Kat Borang 3 tu nanti akan ada cop meterai Mahkamah dan tarikh short call korang... Cool!! Cem gmbr kat atas tu..hehe...

Itu je la.. My process took half day je.

Balik tu naik van putih lagi.. terus pegi KL Sentral.. best!!


Oh and dont forget.. AFTER DAH DAPAT SHORT CALL DATE from the e-filing system...Please serve the Borang 3, 4, 5 to the respective bodies as you did masa serving Borang 1 & 2 dan dont forget to filekan another Affidavit Penyampaian kat Court..

Pemfailan Borang 1 dan Borang 2 (Chambering) - My Experience


I feel obliged to post this entry untuk tatapan adik adik yang nak buat chambering di masa masa kelak. If you are anything like me, you surely akan selongkar any entry yang ada menceritakan tentang PROSES PEMFAILAN BORANG 1 DAN BORANG 2.

I read few blog entries to prepare myself for such process. I asked around my friends yang telah berjaya melepasi tempoh short call. I arranged dan studied my journey and I learned bus mana nak ambil untuk pegi ke Kompleks Mahkamah Jalan Duta.

But nothing can prepare you for such process unless you have experienced it.

FYI, masa my friends filed thier Borang 1 dan Borang 2, sistem pemfailan masih dijalankan secara manual but starting from 1st July 2011, Mahkamah Tinggi telah menjalankan sistem pemfailan secara e-filing. Maka, pengalaman yang saya tempuhi tersangatlah berbeza dari rakan2 seperjuangan.

If you had spend time reading other bloggers entries tentang pemfailan Borang 1 dan Borang 2, you must came across tip paling top yakni BE NICE TO THE CLERKS BEHIND THE COUNTERS. Betul tak? I held on to this tip sampai la I walked out from the Complex. This is true indeed. Respect itu penting. Rata rata yang bagi tips kebanyakan kata buat muka kesian kat diorang.. cemana tu?? What I did what showing my eagerness to learn. Basically you know nothing about the process so just anggap derang mcm chekgu la.. Tanya politely kalau ada tak faham apepe dan they will assist you. I had a pleasant time dengan clerk2 kat Kaunter Rayuan dan Kuasa Kuasa Khas tu.

Tips #02 : Rancang perjalanan.
If you are driving, lucky you.. so damn lucky. Tapi kalau you depend on public transportation, whoahhh memang harus kena rancang sebetul2nya. I am planner when it comes to merancang perjalanan. I studied the map dan familiarized myself (thru google maps) dengan kawasan sekitar court. Dari KL Sentral sampai la ke Kompleks Mahkamah. Ini supaya, bila kita tau kita dah melepasi kawasan2 atau land mark yang kita tau, hati kita lega..

OK Bus ape yang pegi ke Kompleks Mahkamah. Ingat no ni U83 (naik dari KL Sentral) - click untuk study route dia dan B115 (naik dari Pasar Seni) click untuk study route dia. I naik B115 BUT you must know... semudah2 bus B115, sebab dia masuk sampai ke dalam perkarangan court, kekerapan bus ni adalah 70 minit.. Ko tak rasa nak pengsan tunggu bus?? Hahaha.. 

Ada option lain, my friends said that ada van shuttle yang mengenakan bayaran RM2.00/sehala ke court. Derang kata van shuttle warna putih ni tunggu kat Stesen LRT Masjid Jamek. You can ask around tentang perkhidmatan ni. I only had the chance naik van ni dari Court untuk ke Bar Council yang terletak betul depan Stesen LRT Masjid Jamek tu.

Tip #03 : Pastikan anda ada :-
i) pen;
ii) liquid paper;
iii) stapler dan dawai kokot;
iv) borang kosong extra kalau anda terbuat salah.
v) Duit heheh nanti I'll explain why.

These items for me are very very essential, because I used all of them ketika sessi mengisi Borang 1 dan Borang 2. Tanpa benda2 kat atas ni, process mengisi borang akan jadi kucar kacir. This tip I just thought of my own because I know akan ada kesalahan dan definitely akan ada sesi buang staples dan staples balik.

Tip #04 : Wear flats and have a bagpack.
Taking my backpack along was a very very very last minute decision. Dalam bagpack tu blh la di isi fail2 yang anda nak bawa, botol air (bawak la seliter) dan other essentials such as make up kit...(why?? later explained)

Why wear flats? You are required to naik turun naik turun naik turun dan naik dan turun.. mostly sekitar level B1 - 1 - 2 dan mungkin 5. Kalau nak bergerak lambat dan vogue in the vass, pakai la heels ala Lady Gaga.. Kalau nak kejar masa.. pakai la flats.. Mudah cerita..

PROCESS.

I started my journey from home (Bandar Sunway) somewhere dalam pukul 7.45pagi and I hopped on the bus dalam pukul 8.15pagi.

I reached Pasar Seni somewhere around 8.45pagi cem tu dan I am not shy, so I act cem tourist, tanya cemana nak pegi KL Court dan mana nak amik bus B115. The station is next to Stesen LRT Pasar Seni. Turun2 je dari stesen tu, memang dah nampak bus Rapid KL berhimpun ramai2 kat situ. Yang tak bestnya bus B115 ni datang setiap 70min. I didnt know about this so, I actually waited for 65 minutes for the bus to arrived. Watching other busses passed by bikin hati wa fanas oke... Tambang ke KL Court from Pasar Seni is RM1.00 je but with my Rapid Student Pass, I only paid RM0.50.

Perjalanan ke KL Court hanya 20 min ke 30 min dan bus berhenti betul dalam perkarangan Mahkamah, so no worries la nak menapak dari main road ke dalam Mahkamah tu.

Upon entering the Kompleks, sila la naik ke Bahagian Rayuan dan Kuasa Kuasa Khas di tingkat 2 on your left.  Ok, documents required:-
a. Borang 1
b. Borang 2
c. Salinan I.C. (certified true copy by other lawyers but not your master)
d. Salinan Birth Cert (CTC as above)
e. Release letter dari faculty (CTC as above); dan
f. Information of your Master and her/his firm.
Mana nak dapat?? Print dari website Bar Council. Rupa dia cem ni... contoh

CARA NAK ISI FORM BLH DIDAPATI KAT BLOG NI. SANGAT SANGAT MEMBANTU MEMPERCEPATKAN PROCESS PEMFAILAN.

Other than that, u can try to follow the samples of my Forms below:-






 

And then the clerk akan check betul ke tak korang isi form dan akan suruh korang pegi affirm (angkat sumpah) di tingkat satu.. 

Sila pegi buat pembayaran di Kaunter Pembayaran dan blh la pegi beratur kat kaunter commissioner of oath.. Kejap je semua ni. Cost : RM4.00

Pastu, korang pon bawak la pegi naik ke Kaunter Rayuan dan Kuasa Kuasa Khas kat tingkat 2 tadi, just to know that korang kena photostat kesemua dokumen terbabit... 
The whole set together with ur IC bla bla tu.. 4 salinan
Borang 2 sahaja, 32 salinan. Pegi la ke B1 untuk photostat.. Cost:RM10.00.. Staff kat bookshop tu pon dah tau berapa salinan diperlukan.. tak payah cakap.. dia tau la berapa copies diperlukan...

Dah photostat.. di sini lah cabaran bermula kerana my friends tak merasa semua ni..I did.. It's call the SCANNING process untuk tujuan e-filing yang I mentioned above. I took my number somewhere around 11.45am. My number was: 1183.. The current number they were processing was 1075. Ko tak rasa mcm nak terpengsan kat situ??? Di hujung2 corner I heard few lawyers berleter sesama sendiri sebab from 8.30am da amik no tapi dah nak pukul 12 tghr no tak dipanggil2 lagi. Dengan berfikiran positif, I pegi lunch kat B1 dan kembali ke tempat menunggu somewhere around 12.30pm.. and di saat saat ini make up telah pon cair. maka buleh la digunakan make up kit yang anda bawe tu untuk touch up..

And I was lucky that, semasa menunggu tu ada beberapa rakan sebaya yang nak failkan borang 1 jugak bagi number yang awal (1151) - sebab dia jumpa.. She got an ealier number jugak.. Still 1151 was a loooooong way to wait.. So I stayed la waiting kat tempat menunggu tu sampai la pukul 3.00 ptg.. Haaaaaa.. I was rambling about the system kat Facebook thru FB Mobile. I mean WTF e-filing took almost 4 hours to wait.. Gila ke hape..  

The loooong excruciating period of waiting tu hanya untuk Mahkamah scan the document into PDF format and then issue us invoice dan buat bayaran filing. You have 5 - 6 pieces of paper in your hand untuk discankan...dan ko kena tunggu hampir 4 jam.. Bohong la kalau korang penyabar sampai cem tu kan... 

So, after scanning, I rushed to pay the filing fee, RM98.00 BTW dan I rushed to RKKK untuk submit.. 

Taadaaa!!! Done.. Tak susah... Actually tak memakan masa pon.. Cuma tang scanning part tu yang membuatkan semua orang hilang sabar..

Take note : Kaunter pembayaran : buka dari pagi sampai 3.45 sahaja.. tak de lunch break but RKKK dari pagi sampai 3.30 sahaja, lunch break pukul 12.30 sampai 2.00. Kalau tak salah.. so u dont want to mess dengan RKKK.

Nasehat ahkak wahai adek2 sekalian cash tu bawak la dalam RM200... I had RM250 dalam tangan... tgk2 dalam purse ni ada RM50 je... tsk tsk.. mana pegi yang lain lain??? Punah harapan nak beli hair straightener...
